The terms we operate by, and the terms we ask of you.
These Terms of Service govern your use of mikaels.co and any commission, purchase or service provided by MIKAELS. By using this site or placing an order, you accept these terms.
1. Who we are
MIKAELS is a goldsmithing atelier operated by Stefan Mikael. The business is registered in Denmark under CVR 46408101 (VAT ID: DK46408101). References to "we", "us" and "our" mean MIKAELS. References to "you" mean the visitor, customer or commission client. Contact: contact@mikaels.co.
2. Eligibility
To place an order or commission a piece you must be at least 18 years old and able to enter into a binding contract under the laws of your jurisdiction.
3. Orders and contract formation
Adding an item to cart and completing checkout submits an offer to purchase. The contract is formed when we send a written confirmation by email. For commissioned pieces, the binding contract is formed when you approve the written sketch and quote in writing (an email reply is sufficient).
We may decline any order at our sole discretion, in particular where the requested piece exceeds our atelier capacity, requires materials we cannot ethically source, or where pricing has been displayed in error.
4. Pricing and payment
All prices are shown in Danish Kroner (DKK) and include applicable EU VAT for EU shipments. International prices show the pre-VAT price; recipient is responsible for import duties (see Shipping Policy).
For Truly Bespoke commissions a 50% deposit is taken at sketch approval; the balance is due before the piece is hallmarked and shipped. For Editions, full payment is taken at order. We accept the payment methods displayed at checkout.
5. Intellectual property
All designs, photographs, sketches, written content, brand marks and the MIKAELS name are the intellectual property of MIKAELS / Stefan Mikael and are protected by Danish and international copyright and trademark law. You may not reproduce, redistribute or use any of this material commercially without our written permission.
When you commission a piece you receive ownership of the physical piece itself; the underlying design rights remain with MIKAELS. Custom Bespoke designs commissioned exclusively for you are not reproduced for other clients.
6. Warranties and aftercare
Every commissioned piece carries the warranties required by Danish law (Købeloven), including a two-year warranty against manufacturing defects from the date of delivery. We service the work we make, but aftercare beyond that statutory warranty is offered as a paid service quoted per case, not as a blanket lifetime guarantee.
What this means in practice:
- Manufacturing defects identified within two years of delivery are repaired or remade at no charge.
- Resizing is possible only on designs that allow it. Eternity rings — where stones run all the way around the band — cannot be resized after fabrication. We will tell you up-front, before fabrication begins, which category your piece falls into.
- Polishing, refinishing, stone-tightening and repair work after the statutory period are quoted per piece and carried out at the atelier. Postage to and from the atelier is the customer's responsibility unless we have agreed otherwise in writing.
- Aftercare does not cover damage from accidents, work by other jewelers, modifications, or ordinary wear of any plating where applicable.
7. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or in connection with any purchase is limited to the purchase price of the piece in question. We are not liable for indirect or consequential losses such as lost profit, lost business or emotional distress. Nothing in these Terms limits any liability that cannot be limited under Danish law, including liability for personal injury caused by negligence or for fraud.
8. Privacy
Your personal data is handled as described in our Privacy Policy. By using the site or placing an order you consent to that handling.
9. Changes to these terms
We may update these Terms from time to time. The current version is always available at this URL and applies to any order placed after publication. Material changes will be notified to active commission clients by email.
10. Governing law and disputes
These Terms and any dispute arising out of them are governed by the laws of Denmark. Disputes are subject to the exclusive jurisdiction of the Danish courts. EU consumers retain the right to bring proceedings in their own country of residence under EU consumer law. Consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
